Cardi B this week in her lawsuit against Gangsta Beach Music, Vol. 1 , according to Rolling Stone . Cardi previously won a lawsuit brought by California's Kevin Brophy in a jury trial in October, but U.S. District Judge Cormac J. Carney decided on Wednesday, Dec. 28, to uphold the jury's verdict and dismiss Brophy's appeal . forever

Cardi sued the receiver over the tape cover, alleging that Brophy used part of his back tattoo on a model seen performing oral sex on Cardi. Brophy said he suffered emotional distress from the misinformation. However, Cardi's defense argued that Brophy could not prove any physical harm or that anyone could identify her from the tattoo.

Carney appeared to agree with Cardy's defense and the jury finally finding against Brophy in October. In his decision, he wrote that "there was reason enough for the jury verdict." For example, the jury could reasonably conclude that the tattoo on the back of the model on the mixed media cover at issue in this case was not sufficiently identifiable to Brophy to constitute such abuse or misrepresentation. Since the model's face is not visible, it is impossible to identify her based on facial features."

Noting the hybrid cover's artistry, Judge wrote, "Above all, Brophy's tattoos played little part in a larger visual commentary on sexual politics." Brophy's tattoo was simply a tattoo on the model's back, which was in turn drawn by a man with his head between Cardi B's legs as she drank alcohol. The target, Cardi B, has shown that she is in control by reversing traditional gender roles. It's hard to see how the headband's economic value comes from Brophy's tattoo. Despite any evidence to the contrary provided by Brophy, the jury was reasonable in concluding that the use of the tattoo made a difference.

After sharing some of her first promotional photos on Twitter, Cardi recently reminisced about her first collection and it all went wrong. "I had a dream," she admits. She also remembers filming Breaking Hard, one of her husband Offset's music videos.
